    BUSINESS DEVELOPMENT

    The offer of movable goods on the website is not sold by the website operator, but by the seller. A contract is therefore concluded between the buyer and seller when movable goods are purchased. The website operator itself is not a party to this sales contract. The general terms and conditions applicable between the seller and the buyer are included in this document for the sake of simplicity. Note: These terms and conditions are between the buyer and the seller and are therefore not enforceable against the website owner.

    If the seller is based in a country of the European Union (EU), Norway, Liechtenstein or Iceland, the European Distance Selling Directive applies. This directive includes the following rights and guarantees:

    • The seller must provide the buyer with information about taxes, payment, delivery and fulfillment of the contract clearly and in writing.

    • The buyer must receive the order within 30 days, unless a different period has been agreed with the seller. If the movable item in question is not or no longer available, the seller will inform the buyer. Payments made will be refunded within thirty days, unless the seller supplies a similar item.

    • The buyer has a right of withdrawal, which means that the buyer can cancel the purchase for at least fourteen days without giving reasons. Any shipping costs incurred shall be borne by the buyer. Payments made will be refunded within thirty days.

    The Website Operator’s service is an intermediary service provided to a third party. When ordering goods via the Website, the Website Owner is authorized to act as an intermediary in the name and on behalf of the Buyer and to order the goods from the actual seller of the goods in question.

    If the actual seller is based outside the United States and the movable item must therefore be imported, this will be done on behalf of the Buyer. Additional costs, such as import turnover tax and (customs) clearance fees, shall be borne by the Buyer.

    ARTICLE 1 - DEFINITIONS

    • Additional agreement: an agreement whereby the consumer acquires products, digital content and/or services in connection with a distance contract.

    • Grace period: the period within which the consumer may exercise the right of withdrawal.

    • Consumer: the natural person who is not acting in the exercise of a profession or trade and who concludes a contract with the trader.

    • Day: calendar day.

    • Digital content: data produced and delivered in digital form.

    • Distance contract: an agreement concluded within the framework of a system organized by the entrepreneur for the distance selling of products and/or services, exclusively using one or more means of distance communication.

    • Right of withdrawal: the possibility for the consumer to renounce the distance contract within the cooling-off period.

    • Entrepreneur: the legal entity who offers products and/or services at a distance to consumers.

    • General Terms and Conditions: the present general terms and conditions.

    ARTICLE 3 - APPLICABILITY

    These terms apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

    They are made available to the consumer prior to the conclusion of the contract, either electronically or in a durable form. If specific product or service conditions apply, the consumer may always rely on the provision that is most favorable to them in case of conflict.


    ARTICLE 4 - THE OFFER

    • Offers are non-binding and may be modified by the entrepreneur.

    • Each offer contains a complete and accurate description of the products or services, with sufficient detail for the consumer to assess it.

    • Product images are intended as a true representation, but colors may vary slightly.

    • The offer clearly states: price including taxes, delivery costs, payment and fulfillment methods, duration of contract (if applicable), and the right of withdrawal.


    ARTICLE 5 - THE CONTRACT

    The contract is concluded when the consumer accepts the offer and complies with the stated conditions.

    If accepted electronically, the entrepreneur will confirm receipt electronically. Until confirmation, the consumer may dissolve the contract.

    The entrepreneur takes appropriate measures to secure electronic transactions. If the entrepreneur refuses an order, reasons will be provided.

    Upon delivery, the entrepreneur will provide in writing:

    • Address for complaints

    • Conditions of withdrawal (or its exclusion)

    • Information on guarantees and service

    • Price including taxes, delivery costs, and payment method

    • Duration and termination conditions (if applicable)


    ARTICLE 6 - RIGHT OF WITHDRAWAL

    • The consumer has 14 days after receipt of goods to withdraw without reason.

    • If multiple products are ordered, the period begins when the last item is received.

    • For services and digital content not on a tangible medium, withdrawal is possible within 14 days after conclusion.

    • If information on withdrawal was not provided, the period extends up to 12 months.

    Products must be returned with all accessories, in original condition and packaging, unless impossible.


    ARTICLE 7 - COSTS IN CASE OF WITHDRAWAL

    • Consumer bears only return shipping costs.

    • The entrepreneur refunds the full purchase price within 14 days, using the same payment method.

    • Depreciation due to careless handling may be charged.


    ARTICLE 8 - EXCLUSION OF THE RIGHT OF WITHDRAWAL

    Exclusion is possible only if clearly stated at the time of offer and concerns:

    • Customized or personal products.

    • Perishable goods.

    • Goods subject to financial market fluctuations.

    • Newspapers and magazines.

    • Audio/video recordings or software with broken seal.

    • Hygiene products with broken seal.

    • Services relating to accommodation, transport, leisure, etc., tied to specific dates.


    ARTICLE 9 - PRICE

    • Prices include all applicable taxes.

    • Prices remain valid during the offer period, except for changes due to law.

    • Errors in pricing are not binding.


    ARTICLE 10 - GUARANTEE AND CONFORMITY

    The entrepreneur guarantees that products comply with the contract, specifications, and reasonable standards of quality.

    Guarantee does not apply if:

    • Products are repaired or altered by the consumer or third parties.

    • Products are exposed to abnormal use, negligence, or contrary handling.

    • Defects arise from government regulations.


    ARTICLE 11 - DELIVERY AND EXECUTION

    • Orders are executed with due care.

    • Delivery within 30 days unless agreed otherwise.

    • If delivery is delayed, the consumer may terminate the contract and receive a refund within 14 days.

    • Risk passes to the consumer upon delivery.


    ARTICLE 12 - DURATION, TERMINATION AND RENEWAL

    • Indefinite contracts may be terminated by the consumer with one month’s notice.

    • Fixed-term contracts may not be tacitly extended beyond initial terms, except in specific permitted cases.

    • Contracts longer than one year may be terminated by the consumer after one year with one month’s notice.


    ARTICLE 13 - PAYMENT

    • Unless otherwise agreed, amounts due must be paid within 7 working days after the cooling-off period begins.

    • The consumer must report inaccuracies in provided/payment data.

    • In case of non-payment, the entrepreneur may recover reasonable costs.


    ARTICLE 14 - COMPLAINTS

    • Complaints must be submitted within a reasonable period, clearly described.

    • The entrepreneur responds within 14 days. If longer is needed, the consumer will be informed.

    • If unresolved, the complaint may be escalated to the relevant dispute resolution body.


    ARTICLE 15 - DISPUTES

    Contracts between the entrepreneur and the consumer to which these terms apply are exclusively governed by U.S. law.


    ARTICLE 16 - ADDITIONAL OR DIFFERENT PROVISIONS

    Any additional or deviating provisions shall not disadvantage the consumer and must be recorded in writing or durable medium.


    ARTICLE 17 - CLOTHING AND SHOES

    For environmental reasons, clothing and shoes cannot be returned. If an item does not fit, the consumer will receive a 50% voucher to order another size. We recommend gifting the original garment to avoid waste.

    Rationale:

    • In 2018, 17 million tons of textile waste ended in landfills (EPA), representing 5.8% of total waste.

    • Producing one cotton shirt requires ~2,700 liters of water (World Resources Institute).

    • Textiles can take 200+ years to decompose.
